Beedspeed answered that for me - its a hangover from when they tried to introduce a european standard accross all member states, on all parts.
this warning was due to noise.
they gave up on that and let member states handle their own rules and we (uk) let individual testing stations ensure that each bike meets standards as a whole rather than per part. so in the uk its not an issue.
The Simoni is loud - but it sounds brilliant.

Don't think it's as simple as that, aftermarket exhaust makers just don't bother to apply for approval due to cost, so there are few (if any) after market exhausts that carry a kite mark.
When it comes to MOT time it 'should' fail if it is stamped with 'off road use only' though I'm not aware of any exhaust maker who bothers to stamp that (they do tend to on bike pipes) but if it's not loud wont be a problem for the mot.
BUT if you phoned your insurer to tell them about fitting a non standard exhaust they will only accept it if it is stamped with the kite mark..

I have a Simonini on my PX210.......I got an advisory at last MOT for it being too loud. To be honest it is. Changing it for a PM anyway but it does sound good.....if loud!!
