My mate is thinking of buying a Lammy Li 125 that has a 200 lump in it. But he is on L plates/CBT. Aside from the obvious fact that he's not licensed to ride it, what other 'legalities' does he need to consider? I'm guessing the main one will be insurance, and maybe MOT but, as an upstanding citizen, I have no experience of these matters! Cheers P.S I do apologise for asking about a Lammy on a Vespa site!!

You mean if he got busted?
From a legal point of view no valid licence or insurance.
He would have given a false insurance declaration, but they would just void the policy.
Plus, not notifying the DVLA of a change to the engine number and CC.
Don't think it would affect the MOT, engine CC is irrelevant.

Thanks, bryno. Yes, I mean if the worst happened, he had an accident, stopped by a savvy cop etc. I suspect he'd need to be incredibly unlucky, as most peelers I've come across haven't a scooby about scoots, but he needs to know the ramifications if it all goes t*ts up!

guy recently got caught riding a 50cc on a car licence , cept it was a 130 tuned motor .got doin 49 in a 30mph speed trap by a savvy cop . points for no l-plates/no cbt/no licence/no insurance and for speeding=12 month ban an large fine .as scoot was uninsured it was seized an scrapped ,totted up to 5000 an lost his job . oh an still hasnt heard wether insewerants are goin to go at him for fraud . his future ,expensive insurance ,dvla inspecting every registration v5 , an every time a cops camera picks him up probably a roadside check . could of been worse tho, if in a accident thru no fault of ya own , but found uninsured, the numpty who walked or pulled out in front of you but got injured will sue ya an win . 1/2 to a million quid an a lifetime to pay it off ,aswell as the above+prison . got to ask ,is it worth extra 10 mph . H

I guess if you declare it as a 200cc when you insure it technically you would be covered even if it the CC is incorrectly declared on the V5. But, the DVLA would not be best pleased as you are effectively evading tax by not declaring the correct CC of the vehicle, that would no doubt come with a fine and some back tax (the difference between 125 & 200cc classification), probably nothing more than that though, incorrect V5 alone would not invalidate MOT or insurance AFAIK.

How did you sort out insurance, doulsy? they said it had to be specialised insurance because i had changed the engine to a 125, last winter i rebuild my original engine and just stuck it in scooter without informing dvla or insurance, ano this is ilegal, would have stuck with 125 engine if it was not a pile of crap, wonder how many folk have kits and dont inform dvla

Gents, thanks for the feedback. I guess, ultimately, the guy has to decide whether or not the extra mph is worth the risk of being busted. I'll pass on the info, at least then he can make an informed decision

Insurance for a kit or engine change is a bit of a pain, you declare as 'modified' and some of the classic/multibike policies won't cover it, so you need a specialist policy and it starts to get expensive. Wonder how many 30 - 50 year scooters can honestly claim to be 'un-modified':-)

Again, I guess it's whether or not you think it's worth the risk

Wonder how many 30 - 50 year scooters can honestly claim to be 'un-modified':-) yes i agree, had thought of taking my test untill i found out i would need to take lessons on a 400cc motorbike to legally drive my p200, lot a hassle for a few weeks scooter use in the summer.
